Right of inspection of the personal information

     The Act provides the right to the owner of the personal information to request for the inspection of his own personal information or information relating to him. The Act further provides that if the owner of the personal information finds that his information which is in control of the State agency is not accurate, the personal information owner shall have the right to file a written request to the State agency in control of his personal information to correct such information so as to prevent any misuse of such inaccurate information which might have damaged the owner of information. Further, the owner of such personal information shall also have the right to request for the copy of such information.

 

     In the event that the State agency fails to correct such information as requested, the owner of such information may file an appeal to the Tribunal within 30 days from the date he is notified. The State agency shall have to comply with the Tribunal’s decision.

 

     However, whether or not there is an appeal and regardless of the end result of the decision after an appeal was filed, the owner of the personal information shall have the right to request the State agency to attach his note/ remarks to his own personal information in the event that either the State agency or the owner of such personal information affirms that the information in their control is accurate. The note/ remarks is the ultimate strategy to alert the person using such personal information to be fully aware of the accuracy or discrepancy of the information and to use such information with due care.
