Section 9

 

1. A result of consideration or a decision which has a direct effect on a private individual including a dissenting opinion and an order relating thereto
     1) This is the case where the private sector files a request to the State officials to consider particular matter such as the filing for

          permission
     2) This is the case where the private sectors files an objection against the State official’s order, such private sector shall have the

          right to file an appeal with the regulator

2. A policy or an interpretation which does not fall within the scope of the requirement of publication in the Royal Gazette under Section 7 (4)
     This is the case where general public shall have public participation in order to provide advice and guidelines to the State agency in performing its duties such as
     1) National energy policy; and
     2) National police policy.

 

3. a work-plan, project and annual expenditure estimate of the year of its preparation
     Information under this item is not only important information to the contractors or business operators to obtain annual budgetary information but also to equally obtain the plans and the projects of the State agency. This is to enable the fair and competitive in procurement process. Information under this item 3 are, for example:

     1) Model scheme, strategic scheme for short term/ medium term and long term development plan of any State agency
     2) Provincial strategic plans;
     3) Budget of any local administrative organization subsidized by the government; or
     4) Water resources development plan for agricultural purposes.

 

4. A manual or order relating to work procedure of State officials which affects the rights and duties of private individuals:
     There are two sources of manual and order. One of the two is the specific State agency issuing such manual or order and the one is the other State agency issuing the manual or order in order that the other State agency shall have to comply with such manual or order, such as the Ministry of Interior as the regulator supervising the local administrative organizations by issuing certain practice guidelines, such as:
     1) Building construction, alteration and removal manual;
     2) Factory set-up manual; or
     3) Hotel set-up manual, etc.

 

5. The published material to which a reference is made under the Royal Gazette (Section 7, paragraph two):
     Any information that are already published or disseminated is not necessarily re-published in the Royal Gazette but can be used as reference in the Royal Gazette. For the avoidance of doubt and inconvenience, such published material or information should be made available for public inspection.

 

6. A concession contract, agreement of a monopolistic nature or joint venture agreement with a private individual for the provision of public services:
     1) Concession contracts are those contracts where the State gives concession to private sectors to provide any public services or to

         allow privates sectors to make uses of the natural resources, such as concession to run public buses or forestry or mining, etc;
     2) Agreements of a monopolistic nature are those agreements giving private sectors the right to solely operate certain businesses

         such as liquor business, etc; or
     3) Joint venture agreements with a private individual for the provision of public services are those agreements in relation to ventures

         jointly invested and operated between the private individual and the government, such as the agreement to provide telephone          services.


7. A resolution of the Council of Ministers or of such Board, Tribunal, Commission or Committee as established by law or by a resolution of the Council of Ministers;
      Resolutions of the Council of Ministers or the Boards as established by laws which are vital for the public administration include the followings:
     1) Resolutions of the Board;
     2) Resolutions of the Board of the Land Reformation for Agricultural Purposes;
     3) Resolutions of the Board of the Restoration and Development Funds for Farmers, etc.


8. Such other information as determined by the Board.
     Such other information and data as determined by the Board are as follows:
     1) Bidding documents for the State agencies;
     2) Information and data relating to the summary for the monthly State agency’s procurement (Sor Khor Ror Form 1); and
     3) Information and data relating to environment and health.
